The current conflict between the recording industry and a portion of its customers who are involved in illicit copying of music files arose from innovations involving the compression and electronic distribution of files over the internet. This paper briefly describes some of the challenges faced by the recording industry, and examines some of the ethical issues that arise in various industry and consumer responses to the opportunities and threats presented by these innovations. This book argues that a conscientiously objecting medical professional should receive an exemption only if the grounds of an objector's refusal are reasonable. It defends a detailed, contextual account of public reasonability suited for healthcare, which builds from the overarching concept of Rawlsian public reason. The author analyzes the main competing positions and maintains that these other views fail precisely due to their systematic inattention to the grounding reasons behind a conscientious objection; he argues that any such view is plausible (...) to the extent that it mimics the 'reason-giving requirement' for conscience objections defended in this work. Only reasonable objections can defeat the prior professional obligation to assign primacy to patient well-being, therefore one who refuses a patient's request for a legally available, medically indicated, and safe service must be able to explain the grounds of their objection in terms understandable to other citizens within the public institutional structure of medicine. The book further offers a novel policy proposal to deploy the Reasonability View: establishing conscientious objector status in medicine. It concludes that the Reasonability View is a viable and attractive position in this debate. This is a book about the role that psychological impairment should play in a theory of criminal liability. Criminal guilt in the Anglo-American legal tradition requires both that the defendant committed some proscribed act and did so with intent, knowledge, or recklessness. The second requirement corresponds to the intuitive idea that people should not be punished for something they did not do 'on purpose' or if they 'did not realize what they were doing'. Unlike many works in this area, this (...) book addresses the automatism and insanity defences by examining the types of functional impairment that typical candidates for these defences actually suffer. What emerges is a much wider conceptual framework that allows us to understand the significance of psychological states and processes for the attribution of criminal responsibility in a manner that is logically coherent, morally defensible, and consistent with research in psychopathology. Ayn Rand’s Objectivist epistemology is the foundation of an impressive, comprehensive, and integrated system of political philosophy, psychology, art, and literature. Friedrich Hayek’s operational system of epistemology and his analysis of the psychology of perception (presented primarily in The Sensory Order) is not as clearly integrated with his economics and political philosophy—and many have debated their consistency with one another. This paper engages in a comparative analysis of Rand’s and Hayek’s epistemology.

Although the network model represents a promising new approach to conceptualizing comorbidity in psychiatric diagnosis, the model applies most directly to Axis I symptom disorders; the degree to which the model generalizes to Axis II disorders remains open to question. This commentary addresses that issue, discussing opportunities and challenges in applying the network model to DSM-diagnosed personality pathology.

We show the adequacy of axioms and proof rules for strict and lazy functional programs. Our basic logic comprises a huge part of what is common to the two styles of functional programming. The logic for call-by-value is obtained by adding the axiom that says that all variables are defined, whereas the logic for call-by-name is obtained by adding the axiom that postulates the existence of an undefined object for each type. To show the correctness of the axiomatization we do (...) not use denotational semantics and the adequacy of the evaluation of programs with respect to the semantics. Instead we use the standard term models based on call-by-value and call-by-name evaluation. We introduce a new method to prove on the syntactical level the monotonicity of the evaluation of functional programs with unbounded recursion. The direct method yields results concerning the proof-theoretic strength of the axiomatization. As a side result we obtain a syntactical proof of the context lemma for simply typed lambda terms with recursion. (shrink)

Cramer et al. articulate a novel perspective on comorbidity. However, their network models must be compared with more parsimonious latent variable models before conclusions can be drawn about network models as plausible accounts of comorbidity. Latent variable models have proven generative in studying psychopathology and its external correlates, and we doubt network models will prove as useful for psychopathology research.

American adults currently enjoy a widely accepted and legally well-settled right to refuse health care, including life sustaining treatment. Joel Feinberg provides a moral foundation for this right in liberal political theory. Feinberg's theory grounds the right to refuse in a broad right to self-determination, and it implements the right through a variable conception of voluntariness. This theory provides a plausible account that comports with the widely accepted right to refuse, commonsense, and ordinary practice. -/- Allen Buchanan and Dan Brock (...) contend, however, that Feinberg's priority for the right to self-determination is inconsistent with his variable scale of voluntariness. Although Feinberg presents his theory as one that grants categorical priority to self-determination over individual well-being, Buchanan and Brock argue that Feinberg's variable scale of voluntariness involves a balancing of self-determination and well-being. This balancing approach, which Buchanan and Brock endorse, seems to undermine the competent patient's right to refuse care because it allows concern for the patient's well-being to override that person's right to self-determination in some circumstances. Taken together, these arguments seem to suggest that we must give up either the competent patient's right to refuse treatment or the intuitively sensible variable scale. -/- In this paper, I argue that one can reconcile a categorical priority for self-determination with legal rules that incorporate a variable scale of competence. This integration requires careful examination of the practical and expressive functions of legal rules as well as of the manner in which these rules embody moral priorities. This analysis pursues specific and general projects. Specifically, it addresses the moral foundations of the legal right to refuse treatment, identifying a substantive difference between the balancing approach and the priority for self-determination that characterizes Feinberg's liberalism. Generally, it examines the types of priorities embodied by legal rules as practical decision guides and as expressions of the conventional morality represented by the law. This general project extends beyond the right to refuse treatment to the analysis of the manner in which legal rules express and apply moral priorities. (shrink)

Roland Allen’s emphasis on the ministry in missionary churches opens the door to a number of ways in which the church can work to change society, and he makes some very important connections between the promises of the prophets, Jesus announcement of the coming kingdom, and Paul’s missionary methods. In doing so, he again invites the church to bring the good news of the Kingdom of God to the modern world.

It is well understood and appreciated that Gödel’s Incompleteness Theorems apply to sufficiently strong, formal deductive systems. In particular, the theorems apply to systems which are adequate for conventional number theory. Less well known is that there exist algorithms which can be applied to such a system to generate a gödel-sentence for that system. Although the generation of a sentence is not equivalent to proving its truth, the present paper argues that the existence of these algorithms, when conjoined with Gödel’s (...) results and accepted theorems of recursion theory, does provide the basis for an apparent paradox. The difficulty arises when such an algorithm is embedded within a computer program of sufficient arithmetic power. The required computer program (an AI system) is described herein, and the paradox is derived. A solution to the paradox is proposed, which, it is argued, illuminates the truth status of axioms in formal models of programs and Turing machines. (shrink)

An earlier article by the author, "quine and strawson on logical theory" ("analysis" volume 34, pages 207-208), is expanded and defended against criticisms made by charles sayward in "the province of logic" ("analysis" volume 36, pages 47-48). it is shown that quine's definition of logical truth presupposes an understanding of "possibility," even if the term 'sentence' is used set-theoretically, and that if quine is allowed the concept of "possibility," then strawson must be allowed modal concepts for his purposes. the traditional (...) claim that an argument is valid if and only if the corresponding conditional is necessary is also defended.
